Article 1. Scope

These terms relate hire all the services offered by GYRO MALO and its potential partners. Any order or booking entails the acceptance of these terms and conditions by the customer. These rental conditions are available on the website http://www.gyromalo.com.

 

Article 2. Specificity rides Segways

As part of its activities GYRO MALO offers support Segway rental. The circuits can be changed at any time if the coach deems necessary.

Use

The Client will make the Segway strictly according to specifications to its destination and will be responsible for any damage, except in cases of force majeure. If the customer finds a defect or malfunction of the Segway before taking possession, it shall immediately inform GYRO MALO who will make changes if necessary. No later claim would be accepted.

Safety Rules and Recommendations

The Customer must wear a protective helmet which will be available by GYRO MALO. For comfort, the Customer must wear closed shoes, clothing adapted to the weather conditions, the heels are strongly discouraged.

The customer will be aware, implement and enforce the code of good conduct, as well as advice and recommendations issued by the trainer and / or attendant. This charter of good conduct is an integral part of these Terms of Sale.

When a client does not meet the control requirements following the initial training sequence, GYRO MALO reserves the right to deny access after delivery. In this case, there will be a partial refund, up to 60% of the price of the service ordered.

Minors aged 12 to 15 years accompanied by a parent or legal representative may participate in benefits.

 

Article 3. Terms, registration and payment

Reservations can be made for every possible way: phone, email, oral, mail ... the commitment will be effective once the customer has transmitted the registration and reservation form on which it recognizes among others have read the terms and conditions sales and in particular the conditions of use of machinery at its disposal.

A deposit of 30% of the total amount of the benefit is requested at time of booking. The reservation becomes effective upon receipt of this deposit. The balance or the full amount due will be set to GYRO MALO at the latest before the start of the service. In accordance with Article L221-28 of the Commercial Code, the withdrawal period is not applicable.

The settlement of the provision can be made either:

by credit card (Visa, MasterCard, Eurocard, ...)

endorsable by bank check in France

by bank transfer to the account of GYRO MALO,

in cash (euros).

 

The rates advertised on the websites http://www.gyromalo.com are authentic, and if the rates quoted in the specifications issued by GYRO MALO.

Article 4. Cancellation and amendment

By modification means a change of date for the same service. All other cases will be considered a cancellation.

Unavailability, modification or cancellation of the order because of GYRO MALO.

A particular attention is given to the maintenance performed by availability GYRO MALO or its partners. However, in cases of exceptional unavailability of a product despite the confirmation of the booking made by GYRO MALO, the customer will be informed immediately and will be able to choose from:

Unavailability and modification by the Customer.

Any benefit interrupted, abbreviated or consumed by the Customer for any reason whatsoever, including in case of no show or late submission by the service provider or any other place of rendezvous at the time of the order, will be invoiced in full.

GYRO MALO bring great care to study and propose a solution to any change request from the client (date, time, type of service ...) depending on availability.

Cancellation by the Customer

If the request for cancellation of the order by the Customer manages to GYRO MALO:

All cancellations must be notified in writing to GYRO MALO (paper mail / fax / email).

Changing or canceling the booking for reasons beyond GYRO MALO or Client.

If GYRO MALO or provider can not honor the offer controlled, due to extreme weather such as (rain, storm, frost, snow), GYRO MALO inform the Customer at the earliest and will offer him the choice to find with the help of another GYRO MALO availability date for the same animation or other product price equivalent to the offer initially selected.

Failing either of these alternatives, the order will be canceled.

 

Article 5. Execution of delivery and compliance with the order made

GYRO MALO agrees to fulfill the order of the Customer as best she could: the service will be optimal and conform to the order. GYRO MALO guarantees the professionalism of the selected providers and the quality of their services. All services not mentioned when booking will be subject to an additional billing and GYRO MALO is committed to the maximum to meet the demands of the Customer. However, the customer shall in no case to argue the failure GYRO MALO in the execution of these additional services to justify the reimbursement of sums paid as such, nor the interim all the more so.

 

Article 6. Responsibility of Customer and Insurance

The Customer is personally responsible for equipment assigned to him and any breach of the Highway Code. He is responsible for personal injury and damage it causes to others and to themselves when using the equipment.

Responsibility for GYRO MALO could not be committed, especially in case of non-compliance with safety instructions or misuse of the equipment. GYRO MALO reserves the right to charge the customer the cost of repair, refurbishment or replacement of equipment have been damaged, within the deductible fixed in the said contract.

 

Article 7: Complaints

Except in cases of force majeure and without prejudice to any judicial remedy, any claim must be made no later than within 15 days from the date of any injury, by registered letter with acknowledgment at the following address: GYRO MALO 69 Avenue of the fountain at bonhomme- 35400 Saint Malo, accompanied by supporting documents.

 

Article 8. Applicable law

The General Conditions are subject to French law. Any dispute relating to their interpretation and / or execution falls under the arbitration of Saint Malo Trade Tribunal.
